Juries can make mistakes in serious trials.
Double jeopardy prevents a correction of errors made by a jury, so shouldn't we eliminate the idea of a jury.
Answer:
I think it is certainly worth a look. Not only are their ignoramuses on juries - it is remarkably EXPENSIVE and time-consuming to maintain the jury system. I think it is important to review things that become sacred (and expensive) cows like the trial by jury of peers for many things that would be better decided by a panel of trained judges. Judges can more quickly get to the heart of a matter and render and decision.
works for me, I hate being summoned.
No. Maybe just require more solid evidence for convictions or serious sentences, but juries are a good thing overall.
I hate it too! I think though, that juries shouldn't be abolished. Who would our country appoint to make deicisions? If the judge did it, that lays it on one individual who may be right or wrong.
I guess, it is better if there are more people who can talk it over and vote on it rather than one person doing the decision making.
The whole court system is so screwed up right now. The truth no longer matters in justice, everyone is guilty until proven innocent. Jury trials are especially unfair. 12 strangers that just want to get back to their normal lives, who don't really care one bit about what future their decision brings you. Yes, we need to do away with them
You're an idiot. Why don't you go and learn the reason why juries exist instead of asking stupid questions. So you like police states? Good. You're the reason why we are going to have one real soon. Thank you so much.
there are always civil trials.
Juries generally are not made up of one's "peers" which originally what was intended when we were a smaller society. I do not think, however, the jury system should be eliminated; however, I would trust the judgement of a judge in many cases.
no, it is a basic freedom
I think that we shouldn't be forced to attend jury selection, it's almost a violation of our freedom. If we don't go, we will be fined or imprisoned, is that fair?
I think so......thought about it the other day......what a waste of time for some people......think about people who really need t money to live on........or maybe people whom don't necessary need the money but run small companies.....I think fair minded judges should take the place of juries and we should vote on their elction every 2 years just so they don't mess it up.. ...
So ... we eliminate juries because they can make mistakes? What pray tell do propose that we replace these imperfect (human) juries with? Who or what can we put in place that we can fully rely on to be perfect and completely impartial?
NOBODY that I know believes that our judicial system and our jury system are perfect. They are far from it! And frankly, there is MUCH obvious room for improvement. With that said, virtually everyone I know believes that our system works better than anything else going. Again, it is not a question of whether juries or our judicial system sometimes convicts the innocent or acquits the guilty. It's a question of what we go to that will do a better job than what we have now.
If there is ever a time for one individual to make a difference; it is on a jury.
There are currently millions of laws on the books and more written every day. Know one can know every one of them plus the ones yet to come.
As pathetically uninformed as most juries are, juries are We the Peoples last hope!
A juror is the most powerful individual in a court room. More powerful than the judge.
An informed jury knows it can judge the law as well as the accused;
The jury is the final check against out of control tyranny, or just stupidity.
Would you want to eliminate automobiles because there are stupid drivers?
No..you are concerned about the mistakesjuries make...and I would propose that those mistakes are minimal...Now imagine the mistakes or biases that would exist if only the fundamentalist conservative or super bleeding heart liberal was to make the decision as the judge alone?
As an attorney who took several classes in law schools dealing with juries directly and indirectly and several CLE seminars on juries...I have never seen an argument for eliminating juries only reforming the system....attoneys all agree it would be a bad idea.
